This was a recent change, so unless Valve has the ability to see into the future Fusion they wouldn't have been able to use this to make their decision about DLC on the PS3.

Until October 1 2008, video game publishers who wanted to offer downloadable content on the Xbox 360 and PlayStation 3 didn't have to worry about getting a bill from Microsoft and Sony.

That's only a few months back, they could have still got the Medic, Pyro and possibly the Heavy updates out before that if that was the case.
