Perhaps some random game company found out about the M.U.G.E.N Engine, mistook it as an 'Emulator', and brought Elecbyte to court over the matter.  This would definitely explain the "snag" as it would be likely, in that incident, that all work on the project was to stop -immediately- "until further notice".  Trials and hearings don't end in a single day, so it's probably taken them all of this time to settle their case, and since they've actually come back, we can assume that there was either no ruling, or Elecbyte won the case.

That's just speculation, though.
